General Terms and Conditions (GTC)
Houseboat “Wildkraut” – Rental for events and event cruises

§1 Scope
- These General Terms and Conditions (“GTC”) apply to all contracts between the operator of the houseboat “Wildkraut” (hereinafter “Provider”) and the respective contractual partner (hereinafter “Customer”) regarding the use of the houseboat for events, event cruises, private celebrations, corporate events, and other gatherings.
- The GTC apply to all services offered, including supplementary services such as catering, service staff, technical equipment, decoration, or other additional services.
- Deviating terms and conditions of the Customer do not apply unless their validity has been expressly agreed to in writing.
§2 Conclusion of Contract
- Offers made by the Provider are subject to change and non-binding unless they are expressly designated as binding.
- A contract is only concluded upon written booking confirmation by the Provider.

The basis of the contract consists of:
- the individual offer,
- the booking confirmation,
- these GTC.
- Amendments, additions, or side agreements must be made in writing.
- The Customer is obliged to provide the Provider with all information relevant to the event in good time.
§3 Scope of Services
- The scope of the contractual services results exclusively from the individually agreed offer.
- The Provider makes the houseboat “Wildkraut” available to the Customer, including the agreed equipment, for the booked period.
- Additional services are only part of the contract if they have been expressly agreed in writing.
- The Provider reserves the right to make organizational or technical changes, provided these are objectively justified and reasonable.
§4 Prices and Payment Terms
- The prices agreed in the offer apply.
- Upon conclusion of the contract, a deposit of 50% of the total amount is due.
- The remaining balance must be paid no later than 14 calendar days before the start of the event, without deduction.
- Additional costs are charged separately.
§5 Cancellation by the Customer
- Cancellations must be made in writing.

The following cancellation terms apply:
- up to 56 days before the start of the event: 25%,
- up to 28 days before the start of the event: 50%,
- up to 14 days before the start of the event: 75%,
- 13 days or less before the start of the event: 100%.
§6 Withdrawal by the Provider

The Provider is entitled to withdraw from the contract if:
- payments are not made on time,
- safety risks exist,
- force majeure occurs,
- legal regulations are violated.
§7 Use of the Houseboat
- Instructions from the boat operator and staff must be followed at all times.

The following are in particular not permitted:
- open fire,
- fireworks,
- willful damage,
- discriminatory behavior.
- The maximum number of persons must not be exceeded.
§8 Liability
- Use of the houseboat is at the user's own risk.
- The Provider is only liable in cases of intent, gross negligence, or breach of essential contractual obligations.
- The Customer is liable for damages caused by themselves or their guests.
§9 Data Protection
- Personal data is processed for the performance of the contract.

§10 Final Provisions
- German law applies.
- The place of jurisdiction is – to the extent legally permissible – the registered seat of the Provider.
